Upon application by way of an appeal from an order of the Executive Committee of The Metropolitan Toronto and Region Conservation Authority and upon the appellant having failed to attend at the hearing of the appeal although duly notified and upon motion of counsel for the respondent for dismissal of the appeal for want of appearance and for costs and for reasons delivered orally;

  1. It is ordered that the appeal in this matter be and is hereby dismissed.
  2. And it is further ordered that the appellant pay to the respondent its costs of this appeal which costs including disbursements are hereby fixed at $750.
