The Mining Act

In the matter of

Mining Claims KRL-911698 to 911706, both inclusive, 911711 to 911714, both inclusive, 911717 to 911720, both inclusive, 911723 to 911726, both inclusive, 911729 to 911732, both inclusive, 911735 to 911752, both inclusive, and 911755 to 911757, both inclusive, situate in the Aljo Lake Area, 911715, 911716, 911721, 911722, 911727, 911728, 911733 and 911734, situate in the Levitt Lake Area, in the Red Lake Mining Division, hereinafter referred to as the "Mining Claims";

And in the matter of

An application under section 105 of the Mining Act for the transfer of ownership of the Mining Claims from the Respondent to the Applicant.

Order

Whereas this application was received by this tribunal on the 25th day of August, 1997;

And whereas a consent to grant this application without costs, dated the 18th day of September, 1997, was filed by Mr. Owen V. (Tony) Dwyer, Agent, on behalf of the Applicant;

And whereas a consent to grant this application without costs, dated the 18th day of September, 1997, was filed by Dr. Robert Lynn Moxham, on behalf of the Respondent;

  1. This tribunal orders that this application be and is hereby granted.
  2. This tribunal further orders that the ownership of the Mining Claims be transferred from the Respondent to the Applicant.
  3. This tribunal further orders the notation "Pending Proceedings", which is recorded on the abstracts of the Mining Claims, to be effective from the 25th day of August, 1997, be removed from the abstracts of the Mining Claims.
  4. This tribunal further orders that the time during which the Mining Claims were under pending proceedings, being the 25th day of August, 1997, to the 23rd day of September, 1997, a total of 30 days, be excluded in computing time within which work upon the Mining Claims is to be performed.
  5. This tribunal further orders that the 13th day of November, 1997, be fixed as the date by which the next unit of prescribed assessment work must be performed and filed on the Mining Claims, pursuant to subsection 67(3) of the Mining Act and all subsequent anniversary dates are deemed to be November 13 pursuant to subsection 67(4) of the Mining Act.
  6. This tribunal further orders that no costs shall be payable by either party to this application.
  7. This tribunal further orders that this Order be filed without fee in the Office of the Provincial Mining Recorder in Sudbury, Ontario, pursuant to subsection 129(4) of the Mining Act.
