The Environmental Review Tribunal (ERT) continues to provide services to the public.

The ERT continues to hold hearing events scheduled by teleconference or by written format. If necessary, in person hearings may be adjourned to a later date.

To submit new appeals, applications and documents, email erttribunalsecretary@ontario.ca. If electronic documents are larger than 35MB please send in separate emails.

If you experience technical difficulties with the teleconference lines, please continue to try as the system may be temporarily busy.

On March 20, 2020, the Government of Ontario issued an Emergency Order (O.Reg. 73/20) under the Emergency Management and Civil Protection Act. The order suspends limitation periods and procedural time periods relevant to tribunal proceedings. The suspension is retroactive to March 16, 2020.

Effective April 9, 2020, the suspension of limitation periods and procedural time periods under the Emergency Order no longer applies to matters heard by the Niagara Escarpment Hearing Office under the Niagara Escarpment Planning and Development Act. The timeline to appeal a Niagara Escarpment Commission decision on a development permit application is 14 days from the date of the decision.

About the Niagara Escarpment Hearing Office

The Niagara Escarpment Hearing Office administers hearings under the Niagara Escarpment Planning and Development Act involving the Niagara Escarpment Plan. Before a proposal reaches the hearing stage, there will have already been a significant review process and a decision by the Niagara Escarpment Commission evaluating the permit or amendment application. The Niagara Escarpment Hearing Office hears appeals and applications from decisions of the Niagara Escarpment Commission in two situations. A hearing may be held to hear an appeal of a Niagara Escarpment Commission decision on a development permit. A hearing may be held to hear an application to amend the Niagara Escarpment Plan.
