How to File an Appeal

Overview

The process starts with the filing of an appeal. An appeal must be formally submitted within the legislated timelines and be accompanied by the required information and filing fees.

Early participation in the planning process is required for filing some types of appeals and is an important part of filing other types of appeals. Legislation generally sets out who can appeal, how to appeal and within what time frames an appeal must be filed. The Planning Act, for some types of matters, makes specific requirements for an appeal. They include giving an oral presentation at a public meeting or providing written submissions to municipal council. If you are unsure whether you can appeal, please consult the Planning Act or other relevant legislation.

Step One – Can I Appeal Now?

Have you received a copy of the decision made by an approval authority, Municipal Council, Committee of Adjustment or Land Division Committee or seen a notice in the newspaper?

Have you made an application to your municipality for planning approval and not had your matter dealt with within the legislated timelines?

Has the Council neglected or refused to make a decision?

If NO, please contact your local municipality or approval authority for information on the application.

If YES, continue.

Step two – Appeal Type

The decision from your approval authority or municipality will tell you the type of application that was applied for and determines what section and type of legislation you will need to appeal under.

Step Three – Filing Your Appeal

The OMB has prepared specific forms for the most common types of appeals made to the Board. If you cannot find the type of appeal form that applies to your matter, please contact the Board for assistance.

Sending your appeal to the OMB

Some appeals are sent to the municipality first and are forwarded to the OMB. Some appeals are filed directly to the OMB. Please check the first page of the appeal form to see where to send it. Where an appeal is to be filed directly to the OMB please send by mail or deliver in person with the *correct filing fee to:

*The filing fee must be paid by certified cheque or money order, made payable to the Minister of Finance. Do not make the cheque payable to the Ontario Municipal Board.

Step Four – After Filing Your Appeal

After your appeal has been received, the Board will mail you an acknowledgment letter stating your case and file number along with the name of the OMB Planner/Planning Assistant assigned to your case. If you have any questions about your case, please contact the Planner/Planning Assistant indicated in the letter.
