Pre-hearing Conferences & Mediation

Pre-hearing Conferences

The Mining and Lands Tribunal (MLT) may hold a pre-hearing conference, which:

  • Identifies the parties
  • Defines the issues
  • Discloses the evidence (e.g. official records, documents, written statements of witnesses and experts, maps, photos, videos, correspondence) and arranges for the exchange of documents between you and the opposing party
  • Identifies witnesses, their evidence and the order they will appear
  • Discusses the contents of an exhibit list
  • Decides on the procedure to be followed at the hearing
  • Sets a date and time for the hearing to begin and estimates the length of the hearing
  • Considers the possibility of a settlement

Many applications and appeals are settled at the pre-hearing stage. Decisions may then be formalized by an Order of the Tribunal.

Mediation

Mediation may be requested by parties, or may be suggested by the MLT. If all parties agree, a date for mediation will be set. If the mediation is successful, your matter will be either dismissed or granted on consent, with or without conditions. If the mediation is not successful, the matter will proceed to a hearing.
